A few months ago we published the post “Express” approval of renewable projects, where we informed you of the publication of Royal Decree-Law 6/2022, of 29 March, which adopts urgent measures within the framework of the National Plan to respond to the economic and social consequences of the war in Ukraine.
Last Friday, the Royal Decree-Law 11/2022, of 25 June, adopting and extending certain measures to respond to the economic and social consequences of the war in Ukraine, which introduces new features in the “express” approval of renewable projects.
And the fact is that the main innovation introduced by this Royal Decree-Law is exclude projects located in moderately sensitive areas from the procedure for issuing environmental impact reports according to the”Environmental zoning for the deployment of renewable energies” in accordance with the tool developed by the Ministry for the Ecological Transition and the Demographic Challenge.
Also, in order to strengthen public participation in the simplified procedure for authorizing renewable energy projects, that is, those projects that have obtained the report determining a favorable environmental condition, modifications are introduced so that, during the public information process regulated in articles 125 and 126 of Royal Decree 1955/2000, of December 1, appropriate environmental observations can be made (new drafting of article 7.1.c) of RDL 6/2022).
