Are you a risk to the environment? Although we can find references to Environmental Responsibility in Spain since 2008, it was not until 10 years later, when the administration, with the approval of a Royal Decree of application, it has highlighted the term Environmental Responsibility. With this, it seems that we stopped looking at our navels as a society and began to become responsible and aware of what we influence our environment.

The Environmental Responsibility Act

Companies already have a milestone on their calendar: October 2018. From here on, they are forced to take into account the Environmental Responsibility Act (LRMA). A law that seeks to establish the way in which different operators can prevent and avoid the environmental damage that their activities could trigger. It also establishes an economic instrument to cover possible damage to the environment, and to repair them, to the extent that they occur.

To do this, determine the forecast of an amount, called financial guarantee. This will make it possible to restore the original state or to compensate with actions on the medium. A measure that a priori makes sense, since it is a matter of “saving” money to restore the original situation or to compensate the environment for the damage caused. Depending on the type of activity and within one or two years from October 2017, we will be a little more aware of the environmental cost of our activities.

We are finally considering the environment and our livelihood as an asset that we value and for which we demand its recovery or compensation for its loss, just as we do with a car or a house. However, and now comes the small print, this guarantee is provided only for certain activities, chosen according to the nature of their activity and/or the environment in which they are carried out. Is mine one of those affected? When should I have the financial guarantee? , are questions that homeowners must have in their heads ever since.

Another of the strengths of the LRMA is that it is governed by the principle of presumption of guilt, meaning that in the event of a deterioration of environmental conditions and/or an accident, it must be demonstrated that the damage is not a consequence of our activity, nor are we responsible for it.
